The Defendant recognises that this is an offence which is both a mean offence and in breach of trust.
The Defendant is a long-term user of heroin. His life has been entirely focussed on his need for drugs. His offending has been consistent with that need. Fortunately, has not been recalled for breach of licence but it is plainly of concern that he offended so soon after his release.
Generally, his response otherwise to supervision since his release has been good. He has attended supervision sessions and drug counselling; however, he is plainly still heavily addicted to heroin.
The concern is that, if he would steal from his own father in these circumstances, he would probably steal from anyone. In those circumstances, especially given his breach of licence, the court may feel that custody is the only realistic option.
Should the court feel otherwise, the defendant is suitable for a community penalty with a condition of supervision and attendance at an intensive drug counselling and rehabilitation course.
